PLATINUM RACING PRODUCTS

TERMS & CONDITIONS

Platinum RP Pty Ltd (“PRP”, “we”, “our”, “us”)

These Terms & Conditions apply to purchases from PRP, use of PRP websites and services, approved trade accounts, and products supplied directly or through authorised PRP channels.

Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.

1. Definitions

For these Terms:

Customer / You / Your means the person, business, company, partnership, trust or other entity purchasing Goods or Services from PRP.

Goods means products, equipment, components, stock or other items supplied by PRP.

Services means any service provided by PRP.

PRP means Platinum RP Pty Ltd.

PRP-Manufactured Product means a product manufactured by or specifically for PRP and identified by PRP as being eligible for PRP warranty coverage.

Third-Party Product means any product manufactured by another manufacturer and supplied, distributed or resold by PRP.

Terms means these Terms & Conditions, including Appendix A.

GST means Australian Goods and Services Tax or any equivalent applicable tax.


2. General Terms

2.1. All Goods and Services supplied by PRP are subject to these Terms unless otherwise agreed by PRP in writing.

2.2. By purchasing Goods or Services, opening or maintaining an account with PRP, or using our website, You agree to these Terms.

2.3. PRP may update these Terms from time to time. Changes will apply to future transactions from the date the updated Terms are published unless otherwise agreed or permitted by law.

2.4. Changes to these Terms will not retrospectively remove rights that have already accrued under an existing purchase or agreement.

2.5. PRP may refuse an order, account application or future supply where reasonably necessary, including due to product availability, suspected fraud, payment history, regulatory requirements, misuse of an account or other legitimate commercial reasons.

2.6. If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be severed or limited to the minimum extent necessary and the remaining provisions will continue to apply.

2.7. A failure by PRP to enforce a provision of these Terms does not constitute a waiver of that provision.

2.8. These Terms, together with any applicable quotation, invoice, written trade agreement or other written agreement accepted by PRP, form the agreement between the parties.

2.9. Where a separate written agreement expressly conflicts with these Terms, the separate written agreement will prevail to the extent of that conflict.

2.10. Nothing in these Terms excludes, restricts or modifies any statutory guarantee, right or remedy that cannot legally be excluded.


3. Privacy

3.1. PRP may collect personal information reasonably necessary to process orders, provide Goods and Services, administer accounts, communicate with customers, provide support and comply with legal obligations.

3.2. Information collected may include:

  • Name;

  • Business or company details;

  • Email address;

  • Telephone number;

  • Billing and delivery addresses;

  • Order and transaction information;

  • Account information; and

  • Other information reasonably required to provide Goods or Services.

3.3. PRP may disclose relevant information to service providers where reasonably required to provide Goods or Services, including payment providers, freight companies, contractors, technology providers and professional advisers.

3.4. PRP will not sell personal information to unrelated third parties.

3.5. PRP may use contact information for marketing where consent has been provided or where otherwise permitted by applicable law.

3.6. Marketing communications will include an appropriate method of unsubscribing where required by law.

3.7. Personal information may also be disclosed where required or authorised by law.

3.8. Further information regarding collection, storage and handling of personal information may be contained in PRP's Privacy Policy.


4. Purchasing, Pricing & Account Information

4.1 Pricing

Prices may change without notice prior to acceptance of an order.

Unless expressly stated otherwise:

  • Australian prices are exclusive of GST where applicable;

  • International prices may exclude local taxes, duties and import charges;

  • Freight is additional unless expressly included; and

  • Quotes are subject to availability and the conditions stated on the quotation.

4.2 Quotations

Quotes may be affected by changes in:

  • Exchange rates;

  • Freight costs;

  • Insurance;

  • Customs charges;

  • Tariffs and duties;

  • Raw material costs;

  • Supplier pricing; and

  • Production costs.

Unless otherwise stated, a quotation is not binding until accepted by PRP and the required payment or deposit has been received.

4.3 Order Acceptance

Receiving an automated order number, checkout confirmation or email acknowledgement does not necessarily constitute final acceptance of an order.

PRP may review an order before acceptance.

PRP may reasonably:

  • Correct pricing or listing errors;

  • Request further information;

  • Limit quantities;

  • Refuse or cancel an order before fulfilment;

  • Place an order on hold for verification; or

  • Contact the customer regarding an unavailable or incorrectly listed product.

Where PRP cancels an order that has already been paid, PRP will refund amounts paid for the cancelled Goods unless another arrangement is agreed.

4.4 Availability

Product availability is subject to change.

Where part of an order is unavailable, PRP may offer to:

  • Hold the order;

  • Partially fulfil the order;

  • Supply an agreed alternative;

  • Place the unavailable item on backorder; or

  • Refund the unavailable item.

4.5 Customer Information

You must provide accurate and current:

  • Contact information;

  • Billing information;

  • Delivery information; and

  • Account information.

PRP is not responsible for additional costs or delays caused by incorrect information supplied by the Customer, except to the extent caused by PRP.

4.6 Website Information

PRP takes reasonable steps to maintain accurate website information.

Product specifications, images, descriptions, availability and pricing may nevertheless contain errors or become outdated.

PRP may correct genuine errors or omissions at any time.

Nothing in this clause limits rights arising from misleading representations or other rights that cannot legally be excluded.


5. Payment Terms & Debt Recovery

5.1 Standard Orders

Unless written payment terms have been approved, orders must be paid in full before processing or shipment.

5.2 Approved Accounts

Where PRP has approved written payment terms, payment must be made in accordance with those terms.

PRP may review, reduce, suspend or withdraw credit facilities where there are reasonable commercial grounds, including repeated late payment or material breach of agreed account terms.

5.3 Trade Accounts

Unless otherwise agreed in writing:

  • Approved 30-day trade accounts must be paid within the agreed 30-day period;

  • International trade accounts must be paid before shipment unless credit terms have been specifically approved;

  • Prepaid dealer accounts must be paid when the order is placed; and

  • Custom-manufactured, specially sourced, co-branded or customer-specific orders may require partial or full payment in advance.

5.4 Disputed Accounts

A genuine dispute regarding part of an invoice should be raised promptly.

Any undisputed portion of the invoice remains payable in accordance with the agreed payment terms.

5.5 Overdue Accounts

Where an amount remains overdue, PRP may:

  • Suspend further supply;

  • Place an account on hold;

  • Withdraw credit facilities; and

  • Take reasonable steps to recover the debt.

Where permitted by law, the Customer may be liable for reasonable external debt recovery costs incurred because of overdue amounts.

Interest may be charged on overdue commercial accounts where agreed in advance or otherwise permitted by law.


6. Title, Ownership & Risk

6.1 Retention of Title

To the extent permitted by law, title to Goods remains with PRP until all amounts owing for those Goods have been paid in full.

Until title passes, the Customer must not intentionally dispose of, encumber or deal with the Goods in a manner inconsistent with PRP's ownership rights, except where resale in the ordinary course of business is expressly or impliedly permitted.

6.2 Risk

Where PRP arranges delivery, risk in the Goods generally passes when the Goods are delivered to the nominated delivery location, subject to applicable law.

Where the Customer independently appoints and controls its own freight provider or collects the Goods, risk may pass when the Goods are collected by the Customer or its nominated carrier, to the extent permitted by law.

Nothing in this section overrides rights or obligations that cannot lawfully be excluded.


7. Delivery, Shipping & Transit

7.1 Delivery Estimates

Delivery and production dates are estimates unless PRP expressly agrees in writing to a guaranteed date.

PRP is not responsible for delays outside its reasonable control, including:

  • Carrier delays;

  • Customs processing;

  • Industrial action;

  • Weather;

  • Natural disasters;

  • International transport interruptions;

  • Supplier delays;

  • Government action; or

  • Other events beyond PRP's reasonable control.

This does not limit rights that cannot legally be excluded.

7.2 Freight Providers

PRP may select a freight provider based on destination, size, weight, value and service availability.

7.3 Partial Shipments

PRP may, where reasonable, ship an order in multiple consignments.

Additional freight charges will not be imposed without agreement where the split shipment is initiated solely by PRP.

7.4 Direct-to-Customer Deliveries

Where agreed, PRP may ship Goods directly to a Customer's nominated end customer.

The purchasing Customer remains responsible for agreed freight, duties, customs charges and other applicable amounts.

7.5 Transit Damage or Loss

Customers should inspect shipments promptly after delivery.

Any visible freight damage, missing Goods or suspected transit loss should be reported to PRP as soon as reasonably possible so that PRP can investigate and, where applicable, lodge a carrier claim.

PRP may request:

  • Photographs;

  • Packaging;

  • Delivery documentation;

  • Tracking information; and

  • Other evidence reasonably required for a freight claim.

Carrier claim notification periods do not override statutory rights that cannot legally be excluded.

7.6 Authority to Leave

Where a Customer expressly selects or authorises an Authority to Leave service, the Customer acknowledges the additional risk associated with unattended delivery.

Once a shipment has been delivered in accordance with the Customer's Authority to Leave instruction, PRP's liability for subsequent theft or loss may be limited to the maximum extent permitted by law.

PRP recommends delivery to a secure location where a person is available to receive the shipment.

7.7 Freight Insurance

Additional freight insurance may be available upon request or through checkout.

Insurance terms are subject to the applicable insurer or carrier conditions.


8. Free Shipping & Import Duties

8.1 Free Shipping Offers

Where advertised, PRP may offer free or subsidised shipping subject to:

  • Minimum order values;

  • Destination;

  • Product eligibility;

  • Shipment size and weight;

  • Available freight services; and

  • Other conditions stated with the offer.

Free shipping offers may exclude oversized, heavy, dangerous, high-value or special-freight Goods where identified by PRP.

PRP may change or withdraw a promotional shipping offer for future orders.

8.2 No Cash Value

Free shipping:

  • Has no cash value;

  • Cannot ordinarily be exchanged for account credit; and

  • Does not create an entitlement to a shipping refund where no separate shipping amount was paid.

8.3 Partial Returns

Where a discretionary or change-of-mind return causes the retained order value to fall below a promotional free-shipping threshold, PRP may deduct the reasonable original shipping cost from a discretionary refund where this condition was disclosed as part of the offer.

This does not apply where doing so would interfere with statutory rights relating to faulty Goods.

8.4 Import Duties, Taxes & Tariffs

Unless PRP expressly agrees otherwise in writing, international Customers are responsible for:

  • Import duties;

  • Tariffs;

  • Customs charges;

  • Local taxes;

  • Brokerage;

  • Government fees; and

  • Other destination-country charges.

The applicable Incoterm or customs treatment may be stated on the quotation, order confirmation or commercial invoice.

8.5 Refused International Shipments

Where a shipment is refused or returned because:

  • Customs charges were not paid;

  • The Customer supplied incorrect information;

  • The Customer refused clearance; or

  • Delivery could not be completed for reasons attributable to the Customer,

PRP may deduct reasonable freight, return freight, customs and handling costs from any refund otherwise payable, to the extent permitted by law.


9. Returns, Refunds & Cancellations

This section distinguishes between change-of-mind returns and rights relating to faulty Goods or statutory consumer guarantees.

9.1 Change of Mind

Unless PRP expressly agrees otherwise, PRP does not offer refunds for:

  • Change of mind;

  • Incorrect selection by the Customer;

  • Finding an item cheaper elsewhere; or

  • No longer requiring the Goods.

PRP may choose to approve a discretionary return.

Where approved, PRP may require Goods to be:

  • Unused;

  • Uninstalled;

  • Unmodified;

  • Complete;

  • In saleable condition; and

  • Returned with original packaging where reasonably available.

Reasonable restocking or administration costs may apply to discretionary returns if disclosed before the return is accepted.

9.2 Custom and Special Orders

Goods that are:

  • Custom manufactured;

  • Specially ordered;

  • Modified at the Customer's request;

  • Co-branded;

  • Personalized; or

  • Procured specifically for a Customer

cannot ordinarily be cancelled or returned for change of mind once production, procurement or modification has commenced.

This does not limit rights relating to faulty Goods or other rights that cannot legally be excluded.

9.3 Faulty Goods

Nothing in PRP's change-of-mind policy applies to Goods that fail to meet applicable statutory consumer guarantees.

A Customer making a claim for faulty Goods is not required to retain original packaging as a condition of exercising rights available under the Australian Consumer Law.

Proof of purchase may reasonably be required.

9.4 Cancellations

Where a Customer requests cancellation before fulfilment, PRP may approve the cancellation.

Reasonable and unavoidable costs already incurred in processing, payment fees, supplier commitments, custom production or procurement may be deducted where legally permitted and appropriately disclosed.

PRP will not impose a cancellation fee that operates as a penalty.

9.5 Returns Following Promotional Sales

A later sale or promotional price does not create an entitlement to a retrospective discount, credit or refund for Goods purchased earlier.

9.6 Faulty Product Return Costs

Where applicable under Australian Consumer Law:

  • Customers may initially be required to return Goods that can reasonably be posted or returned;

  • PRP may be responsible for collection or transport of Goods that are large, heavy or otherwise difficult to return; and

  • Where a product is confirmed to have a covered fault, reasonable return costs paid by the Customer will be reimbursed where required by law.


10. Warranties

10.1 PRP-Manufactured Products

Eligible PRP-manufactured products are covered by the PRP Lifetime Warranty contained in Appendix A.

Appendix A forms part of these Terms.

10.2 Third-Party Products

Products manufactured by third parties are subject to the applicable manufacturer's warranty where available.

PRP does not represent that a Third-Party Product is covered by PRP's Lifetime Warranty unless expressly stated.

Where PRP is the supplier to an Australian consumer, referring a Customer to a manufacturer does not remove any obligation PRP may have as the supplier under Australian Consumer Law.

10.3 Statutory Rights

PRP's voluntary warranties are additional to, and do not replace, statutory consumer guarantees or other rights that cannot legally be excluded.


11. Intended Use & Limitation of Liability

11.1 Performance and Competition Use

Many PRP products are designed for modified, high-performance, motorsport, competition or off-road applications.

Where a product is designated for race, competition or off-road use only, the Customer is responsible for determining whether its installation and use are lawful in the applicable jurisdiction.

Modification of a vehicle may affect:

  • Road registration;

  • Insurance;

  • Emissions compliance;

  • Safety certification;

  • Manufacturer warranties; and

  • Other legal requirements.

The Customer is responsible for obtaining any required approvals.

11.2 Installation and Setup

Performance components must be appropriately:

  • Selected;

  • Installed;

  • Assembled;

  • Configured;

  • Tuned;

  • Lubricated;

  • Maintained; and

  • Operated.

PRP is not responsible for loss or damage caused by incorrect installation, incorrect setup, incompatible components, misuse, inadequate maintenance or operation outside the product's intended specifications.

11.3 Limitation of Liability

To the maximum extent permitted by law, PRP is not liable for loss arising from:

  • Misuse or abuse;

  • Incorrect installation;

  • Incorrect tuning or setup;

  • Incompatible components;

  • Unauthorised modification;

  • Failure to maintain or service Goods appropriately;

  • Use outside published specifications or intended application; or

  • Continued operation after a known or reasonably apparent fault.

Where liability may lawfully be limited, PRP's liability will be limited to the extent permitted by applicable law.

11.4 Consequential Loss

To the maximum extent permitted by law, PRP excludes liability for indirect or consequential commercial loss including:

  • Loss of revenue;

  • Loss of profit;

  • Loss of production;

  • Loss of business opportunity; and

  • Vehicle or equipment downtime.

However, this exclusion does not apply to liability that cannot lawfully be excluded, including any entitlement to compensation for reasonably foreseeable loss or damage arising from a breach of applicable consumer guarantees.


12. Product Information, Fitment & Special Orders

12.1 Product Fitment

Customers must confirm that Goods are suitable for their particular application.

References such as “bolt-on”, “plug-and-play”, “direct fit” or similar descriptions assume the vehicle, engine, electrical system, drivetrain or associated components are otherwise in the configuration specified by PRP.

Modified vehicles may require additional parts, fabrication, tuning or adjustment.

12.2 Product Images

Product photographs and digital renders are provided as a guide.

Minor variations may occur in:

  • Colour;

  • Finish;

  • Hardware;

  • Manufacturing revisions;

  • Surface appearance; and

  • Packaging.

Computer screens and mobile devices may display colours differently.

Material differences affecting product function or specification will not be intentionally substituted without appropriate disclosure.

12.3 Surface Finishes

Anodising, coating, plating, polishing and other finishes may display reasonable variation between manufacturing batches.

Cosmetic variations that do not materially affect the product's function are not necessarily manufacturing defects.

12.4 Custom Requirements

Customers requiring:

  • Specific dimensions;

  • Specific finishes;

  • Unusual fitment;

  • Custom configurations; or

  • Non-standard applications

should obtain written confirmation from PRP before ordering.

12.5 Production and Special-Order Lead Times

Any quoted production or special-order lead time is an estimate unless PRP expressly agrees otherwise in writing.


13. Giveaways & Promotional Credits

13.1. Individual promotions, competitions or giveaways may be subject to separate promotional terms.

13.2. Where separate promotional terms conflict with this section, the specific promotional terms will apply.

13.3. Eligibility requirements, entry periods, prize details and winner selection methods will be stated with the applicable promotion.

13.4. Promotions will be conducted subject to applicable laws, permit requirements and trade promotion regulations.

13.5. Unless otherwise stated:

  • Entrants must satisfy the published eligibility requirements;

  • Entries must be received during the applicable promotional period;

  • Prizes cannot be exchanged for cash;

  • Promotional credits apply only to eligible products;

  • Credits cannot be sold or transferred unless expressly permitted; and

  • Third-party prizes are subject to the applicable third-party manufacturer's warranty.

13.6. Where permitted by law and stated in the applicable promotion, entrants or winners may consent to reasonable use of their submitted content, name or likeness for promotion of the competition.

13.7. PRP may suspend, modify or cancel a promotion where reasonably necessary due to fraud, technical failure, legal requirements or circumstances outside PRP's reasonable control.


14. Website Terms, Intellectual Property & Third Parties

14.1 Website Use

You must not use PRP's website or systems:

  • For unlawful purposes;

  • To commit fraud;

  • To introduce malicious software;

  • To interfere with website security;

  • To scrape or collect information unlawfully;

  • To impersonate another person;

  • To infringe intellectual property rights; or

  • In any manner that materially disrupts the website or services.

14.2 Intellectual Property

Unless otherwise stated, PRP owns or licenses the intellectual property contained within its website and marketing materials, including:

  • Logos;

  • Product photographs;

  • Product descriptions;

  • Graphics;

  • Designs;

  • Text;

  • Videos; and

  • Other content.

Content must not be reproduced, commercially exploited or distributed without permission except where permitted by law.

14.3 Customer Submissions

Where a Customer voluntarily supplies photographs, reviews, videos, testimonials or other content to PRP for promotional use, PRP may use that content to the extent agreed with the Customer or otherwise permitted by law.

The Customer must not intentionally provide content that infringes another person's rights.

14.4 Third-Party Tools and Links

PRP websites may provide access to third-party:

  • Payment providers;

  • Websites;

  • Software;

  • Applications;

  • Freight platforms; and

  • Other services.

Third-party services may be subject to their own terms and privacy policies.

PRP is not responsible for the independent conduct of third-party services except to the extent PRP is legally responsible.

14.5 Errors and Omissions

PRP may correct genuine typographical, pricing, technical or administrative errors.

Where an error materially affects an order already placed, PRP will contact the Customer and provide an appropriate option, which may include confirming revised details or cancelling and refunding the affected Goods.


15. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

The parties submit to the jurisdiction of the courts and tribunals having jurisdiction in New South Wales, subject to any mandatory rights a Customer may have to bring a claim in another jurisdiction.

For international Customers, nothing in these Terms is intended to exclude mandatory consumer rights applicable under the laws of the jurisdiction where those rights legally apply.

APPENDIX A

PRP LIFETIME WARRANTY TERMS & CONDITIONS

Effective Worldwide – Applies to Eligible PRP-Manufactured Products Only

A1. Warranty Provider

This Lifetime Warranty is provided by:

Warranty claims may be submitted to the above email or business address.


A2. Application of This Warranty

PRP provides a Lifetime Warranty on eligible PRP-manufactured products subject to this Appendix.

The Warranty applies worldwide to eligible products purchased directly from PRP or an authorised PRP distributor.

The Warranty does not apply to:

  • Third-party products;

  • Accessories or components not manufactured by PRP;

  • Electronics not manufactured by PRP;

  • Tools;

  • Consumables; or

  • Other products merely supplied, included, distributed or resold by PRP,

unless PRP expressly states otherwise.

This Warranty is a voluntary warranty provided in addition to rights and remedies that may exist under applicable law.


A3. Warranty Overview

The Lifetime Warranty covers defects attributable to PRP's manufacture of an eligible product, including defects in:

  • Materials;

  • Workmanship;

  • Manufacturing tolerances; and

  • Manufacturing processes.

The Warranty does not insure the product against every type of failure.

A failure must be attributable to a covered manufacturing defect rather than misuse, wear, incorrect installation, incorrect operation, inadequate maintenance or another excluded cause.


A4. Warranty Period – Meaning of “Lifetime”

For the purpose of this Warranty, the Warranty Period begins on the original date of purchase and continues for the functional service life of the product while it remains owned by the original purchaser, subject to the conditions and exclusions in this Appendix.

“Lifetime” means the expected functional service life of the PRP-manufactured product when it is:

  • Correctly installed and assembled;

  • Operated within its intended application;

  • Operated within PRP's published specifications or ratings;

  • Properly maintained and serviced;

  • Used with correct and PRP-recommended oils, lubricants, fluids and consumables; and

  • Not subjected to misuse, abuse, neglect, unauthorised modification or abnormal operating conditions.

A Lifetime Warranty does not mean that a product will last indefinitely.

Normal:

  • Wear;

  • Fatigue;

  • Deterioration;

  • Erosion;

  • Corrosion;

  • Consumable replacement; and

  • End-of-service-life deterioration

are not manufacturing defects.

The Warranty is available only to the original purchaser and is non-transferable unless PRP expressly agrees otherwise in writing.


A5. What Is Covered

The Warranty covers eligible manufacturing defects including:

  • Defective material attributable to manufacture;

  • Defective workmanship;

  • Incorrect manufacturing tolerances; and

  • Other defects attributable to PRP's manufacturing process.

Where a covered manufacturing defect is established, PRP will provide the remedy required by this Warranty and applicable law.

Subject to any statutory right to choose a remedy, PRP may repair or replace the affected PRP-manufactured product or component.


A6. Misuse, Abuse & Operation Outside Intended Conditions

The Warranty does not cover failure or damage caused or contributed to by:

  • Misuse;

  • Abuse;

  • Neglect;

  • Excessive load;

  • Shock loading;

  • Impact;

  • Abnormal operating conditions;

  • Overheating;

  • Detonation;

  • Incorrect tuning;

  • Incorrect system or vehicle setup;

  • Incorrect operation;

  • Operation outside PRP's published specifications;

  • Exceeding published power, torque, RPM, load or other operating limits;

  • Accidents or external damage; or

  • Continued operation after a fault or warning sign has become reasonably apparent.

Warning signs may include:

  • Abnormal noise;

  • Excessive heat;

  • Loss of lubrication;

  • Contaminated lubricant or fluid;

  • Metal contamination;

  • Abnormal vibration;

  • Loss of pressure; or

  • Other evidence of an existing mechanical problem.

Where relevant to determining the cause of a failure, PRP may reasonably request the tune file and/or relevant data logs from the time the failure or issue occurred.


A7. Installation & Assembly

The Warranty does not cover failure or damage caused or contributed to by:

  • Incorrect installation;

  • Incorrect assembly;

  • Incorrect tolerances or clearances;

  • Incorrect alignment;

  • Incorrect torque settings;

  • Incorrect sealing;

  • Incorrect fastening;

  • Incorrect setup or adjustment;

  • Inadequate lubrication;

  • Installation with incompatible components; or

  • Installation that does not comply with applicable PRP instructions, specifications or accepted industry practice.

PRP may reasonably request evidence regarding the installation or assembly of a product when relevant to determining the cause of failure.

PRP recommends that products requiring technical installation or assembly be installed by a suitably qualified and experienced industry professional.

A warranty claim will not be refused merely because a particular workshop was not used where doing so would be inconsistent with applicable law. However, damage caused by incorrect installation or assembly is not covered.


A8. Oils, Lubricants & Fluids

Correct lubrication is a condition of this Lifetime Warranty where lubrication is relevant to the product.

The Warranty does not cover failure or damage caused or contributed to by:

  • Incorrect oil;

  • Incorrect lubricant;

  • Incorrect fluid;

  • Incorrect viscosity;

  • Incorrect specification;

  • Insufficient lubrication;

  • Incorrect fluid level;

  • Contaminated lubricant;

  • Degraded lubricant;

  • Inappropriate additives; or

  • Failure to use a product meeting PRP's published or recommended specification.

Where relevant to a claim, PRP may request evidence of the oil, lubricant or fluid used.


A9. Maintenance & Servicing

Products must be serviced and maintained appropriately for:

  • Their application;

  • Operating conditions;

  • Usage;

  • Performance level; and

  • PRP's published maintenance recommendations.

The Warranty does not cover failure or damage caused or contributed to by:

  • Inadequate servicing;

  • Inadequate maintenance;

  • Failure to follow applicable PRP maintenance recommendations;

  • Failure to replace oils, lubricants, fluids or consumables when reasonably required;

  • Failure to investigate contamination;

  • Failure to investigate abnormal wear;

  • Failure to investigate warning signs; or

  • Continued use after a product is known or reasonably suspected to be damaged or operating incorrectly.

PRP does not impose a single universal servicing schedule under this Warranty.

Servicing requirements depend on the product, application, operating conditions and usage.

PRP may request reasonable service and maintenance records where those records are relevant to determining the cause of a failure.


A10. Third-Party Components

The PRP Lifetime Warranty does not cover products or components not manufactured by PRP.

It also does not cover damage to an eligible PRP product caused or contributed to by:

  • Incompatible third-party components;

  • Third-party product failure;

  • Incorrect electronics or wiring;

  • Incorrect tuning;

  • Incorrect accessories;

  • Incorrect fluids; or

  • Other external components.

A third-party component being used with a PRP product does not by itself void this Warranty.

Coverage may only be affected where the third-party component caused or contributed to the failure or prevents PRP from reasonably determining the cause.


A11. Wear & Consumable Items

Normal wear and consumable items are not covered by the Lifetime Warranty.

This includes any item or surface that is reasonably expected to:

  • Wear;

  • Degrade;

  • Erode;

  • Be adjusted; or

  • Require periodic replacement

during normal operation or servicing.

A wear-related failure is not a manufacturing defect merely because it occurs during the Warranty Period.


A12. Modifications & Repairs

The Warranty does not cover failure caused or contributed to by:

  • Unauthorised machining;

  • Material alteration;

  • Incorrect modification;

  • Incorrect repair;

  • Incorrect rebuilding;

  • Incorrect disassembly;

  • Use of incompatible components; or

  • Use in an application materially different from the product's intended purpose.

Modification does not automatically void every aspect of the Warranty.

PRP will consider whether the modification or repair caused or contributed to the claimed failure.


A13. Warranty Claim Evidence

To assess a claim, PRP may reasonably request information including:

  • Proof of purchase;

  • Product identification;

  • Serial number where applicable;

  • Application details;

  • Installation information;

  • Installation records;

  • Service and maintenance records;

  • Oils, lubricants and fluids used;

  • Photographs;

  • Videos;

  • Tune files;

  • ECU or operational data;

  • Data logs; and

  • Return of the affected product for inspection.

PRP will only request information reasonably relevant to assessing the cause of the claimed failure.

Failure to provide information reasonably necessary to assess a claim may affect PRP's ability to determine whether the claim is covered.


A14. Inspection & Assessment

PRP may require the affected product to be inspected before determining a warranty claim.

Inspection may be undertaken by:

  • PRP;

  • An authorized PRP facility; or

  • Another suitably qualified person nominated by PRP.

The assessment may consider:

  • Manufacturing condition;

  • Material condition;

  • Installation;

  • Assembly;

  • Lubrication;

  • Maintenance;

  • Operating conditions;

  • Wear patterns;

  • Contamination;

  • Modifications;

  • External components; and

  • Evidence of misuse or operation outside intended specifications.

PRP may undertake a technical or engineering root-cause assessment where appropriate.

The purpose of the assessment is to determine, on the available evidence, the likely cause of the failure.

Nothing in this section prevents a Customer from exercising any right of review, remedy or dispute resolution available under applicable law.


A15. Warranty Remedy

Where PRP determines that an eligible product has failed because of a covered manufacturing defect, PRP will provide the applicable warranty remedy.

Subject to any statutory right of the Customer to choose another remedy, PRP may:

  • Repair the defective product;

  • Replace the defective product or component; or

  • Supply an equivalent replacement where the original product is no longer available.

A replacement product may incorporate later design or manufacturing revisions.

Nothing in this Warranty limits any remedy that must be provided under applicable consumer law.


A16. Warranty Claim Expenses

Unless applicable law requires otherwise, the Customer is initially responsible for reasonable costs of returning a product to PRP for assessment.

Where a covered defect is confirmed, PRP will reimburse reasonable return freight costs where required by applicable law.

Customers should retain receipts or other evidence of freight or transport expenses.

Where PRP reasonably determines that:

  • No defect exists;

  • The failure is excluded from the Warranty; or

  • The failure was caused by misuse, incorrect installation, inadequate maintenance or another non-warranty cause,

the Customer may be responsible for return freight and reasonable inspection or assessment costs where permitted by law and where those costs have been appropriately disclosed.

For large, heavy or difficult-to-return Goods, PRP will comply with any applicable legal obligation relating to collection or freight.


A17. Costs and Consequential Loss

Unless otherwise required by applicable law, the voluntary PRP Lifetime Warranty itself does not cover:

  • Labour for removal;

  • Labour for installation;

  • Tuning;

  • Setup costs;

  • Oils;

  • Lubricants;

  • Fluids;

  • Consumables;

  • Transport;

  • Towing;

  • Vehicle downtime;

  • Loss of use;

  • Loss of production;

  • Loss of revenue; or

  • Loss of profit.

This exclusion applies only to the voluntary Lifetime Warranty.

It does not exclude any entitlement to recover loss, damage, expenses or compensation that cannot lawfully be excluded under applicable consumer law.


A18. Australian Consumer Law

For Goods supplied to consumers in Australia, the benefits provided by this Lifetime Warranty are in addition to other rights and remedies available under Australian law.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

These statutory consumer guarantees operate independently of PRP's Lifetime Warranty.

Nothing in this Warranty excludes, restricts or modifies those guarantees.


A19. Making a Warranty Claim

To make a claim:

  1. Contact PRP or the authorized PRP distributor through which the product was purchased.

  2. Provide proof of purchase.

  3. Provide product identification or serial information where applicable.

  4. Describe the failure and circumstances in which it occurred.

  5. Provide information reasonably requested by PRP regarding installation, operation, lubrication, servicing and maintenance.

  6. Provide photographs, video, tune information or operational data where reasonably relevant.

  7. Return the product for inspection where reasonably required.

PRP will assess the available evidence and advise the Customer of the outcome and applicable remedy.


A20. Grounds for Refusing a Lifetime Warranty Claim

A claim under the voluntary PRP Lifetime Warranty may be refused where PRP reasonably determines that the failure was caused or materially contributed to by:

  • Misuse;

  • Abuse;

  • Neglect;

  • Incorrect installation;

  • Incorrect assembly;

  • Incorrect tuning;

  • Incorrect setup;

  • Incorrect oil, lubricant or fluid;

  • Inadequate lubrication;

  • Inadequate servicing;

  • Inadequate maintenance;

  • Normal wear;

  • Unauthorized or incorrect modification;

  • Incompatible components;

  • Accident or external damage;

  • Operation outside intended specifications; or

  • Continued operation after an existing fault became reasonably apparent.

The presence of one of these circumstances does not automatically exclude an unrelated manufacturing defect.

PRP will assess whether the excluded circumstance caused or contributed to the failure being claimed.


A21. International Customers

This Lifetime Warranty is offered worldwide on eligible PRP-manufactured products.

International Customers remain subject to applicable local law.

Nothing in this Warranty is intended to exclude a mandatory consumer right or remedy that legally applies in the Customer's jurisdiction.

Where local mandatory law provides greater rights than this voluntary Warranty, those rights continue to apply.


A22. Governing Law

This voluntary Lifetime Warranty is governed by the laws of New South Wales, Australia.

This governing-law provision does not exclude any mandatory statutory rights available to a Customer in another jurisdiction where those rights legally apply.
